Profile Holidays Discount Card – Card Holder Terms and Conditions
1.Profile provides which entitles the holder to discounts or other benefits with the service providers’ who have agreed top participate in Profiles’ Card scheme.
2. These are the Terms on which Profile issues to Card Holders.
3. In these Terms: “You” and “Your” refer to the holder of the Profile Holidays Card. “We”, “Our” and “Us” refer to Profile.
4. You provide the following information which you want is correct.
4.1 Your full name
4.2 Your postal address
4.3 Your email address
4.4 You are over the age of 18 and are not subject to any disability
5. You agree to pay Us on issue of Your Card Issue Fee.
6. Once the Card Issue Fee is paid it is non-refundable under any circumstances.
7. Your Card will remain valid during the Term which:
7.1 Commences on the Commencing Date
7.2 Ends on the Terminating Date
8. We warrant that We have negotiated with the Providers to provide the benefits to Card Holders.
9. While the card remains valid you are entitled to the benefits.
10. We do not make booking arrangements with Service Providers. You must contact Providers directly
10.1 The card may only be used by You and cannot be lent or transferred.
10.2 When booking with a Provider You must notify the Provider that You are a Card Holder.
10.3 When arranging payment for a service You must produce to the Provider Your card and such evidence as the Provider reasonably requires as to Your identity.
11. Apart from Your entitlements to the benefits the Providers have agreed to treat Card Holders in the same manners as they would treat any other customers.
11.1 You acknowledge that:
11.2 A Provider may not be able to provide services on a particular date or time preferred by You;
11.3 You must comply with all reasonable requirements of the Provider;
11.4 If You suffer from any disability or characteristic which would restrict the services required by You or which would prevent You from participating in the services You must accept the restriction or consequential refusal of the service and are not entitled to any refund in this regard.
11.5 If the Provider normally requires customers to provide particular items of clothing or protection or to have undergone levels of training You must satisfy the Providers requirements.
12. We maintain websites on which we endeavor to provide current information about Our activities, the Providers and the services supplied by the Provider including their current charges.
12.1 Where possible we provide links to the websites of our Providers.
12.2 You are invited to access information regarding Us and Our Providers through our website.
12.3 Where possible We have arranged benefits with Providers we believe to be reliable and financially sound.
12.4 We cannot guarantee that all of Our Providers will continue to provide their services throughout the Term.
12.5 If any of our Providers cease to provide it’s services during the Term we will use all reasonable efforts to negotiate the provision or similar or equivalent benefits by a replacement Provider.
12.6 We will not be liable for any loss which You suffer by reason of one or more of the Providers ceasing to provide some or all of their services during the whole or any parts of the Term.
13. You acknowledge having read and understood these Terms before agreeing to acquire a card.
14. You will agree that We will not be liable to You for any loss or harm which You suffer in or from the provision to You of any goods or services by a Provider.
15. You indemnify Us against any claim which might be made by You or by any third party arising out of or in connection with the provision to You of any goods or services by a Provider.
16. To the extent allowed by law:
16.1 The maximum liability which We have to You for any matter arising out of or in connection with this Agreement is:
16.1.1 To re-supply any services provided under this Agreement
16.2.2 To refund any payment made to Us;
17. We will not be liable to You for any general specific punitive or exemplary damages, any direct or indirect loss, economic loss or for the loss in value of any asset.
18. If a cheque provided by you or any credit card authorization is cancelled or cannot be accessed We are entitled without notice to You to cancel the Card and You will not be entitled to ay benefits until payment or reimbursement has been effected.
Definitions
In these Terms:
- “Benefits” means any discounts, allowances and considerations allowed by Providers pursuant to the Terms of their Agreement with Profile for the benefit of Card Holders.
- “Card” means a Discount Card issued by Profile pursuant to these Terms.
- “Card Holder” means the person to whom a card has been issued.
- “Commencing Date” means the date upon which You receive your Profile Holidays Card.
- “Terminating Date” means the terminating date specified on Your Profile Holidays Card.
- “Profile” means Profile Holidays and Gold Coast Profile Pty Ltd ABN 94 122 208 820 its successors and assigns.
- “Provider” means a supplier of goods or services with whom Profile has negotiated benefits for Card Holder.
You acknowledge that:
- In respect of transport services Your card and identification must be presented upon boarding the vehicle.
- In respect of restaurants and similar services Your card must be presented upon payment of food bill.
- In respect of nightclubs and similar services You must present Your card and identification upon arrival.
- In respect of activities and tours You must present Your card and identification upon arrival at activity or tour.
- In respect of transport services one card is required in respect of each group transfer.
- In respect of restaurants and similar services one card is required per table to receive the benefits.
- In respect of nightclubs and similar services one card is required per adult.
- In respect of activities and tours one card is required per adult
By reading these Terms and purchasing Your Profile Holidays Discount Card, you are bound to them.
